These terms regulate the use of the software tool Emerald created by Travelpayouts (hereinafter referred to as the "Service" or “Service software” if used in the context of intellectual property rights for respective works protected by copyright). The Partner, using the Service, is considered to have agreed to the current version of these terms, taking into account any changes and updates that may be adopted from time to time, fully and unconditionally.
The Service is made available to the current Partners of the Travelpayouts affiliate network. The Service aims to assist Partners in generating more revenue from their web resources by implementing or replacing promotional tools and optimizing traffic/audience acquisition. The Service provides the capability to analyze visitors’ (end-users) interactions with the web resource pages, identify key performance indicators, and may help to improve monetization of the Partner’s traffic on a web resource.
To use the Service the Partner has to implement the received Emerald code on the web resource and respective Word Press plugin. The fact of implementation is linked with the Partner’s id (marker) assigned after registration in the Travelpayouts affiliate network and respective web resource.
The Service, when implemented by the Partner according to documentation and section “License and permitted use”, is intended to provide the Partner with insight on the web recourse indicators and optimization of monetization on the web resource as follows:
The Partner acknowledges and accepts that the Service operates automatically based on the data processed by the software solution. The Partner and Travelpayouts may, only by mutual agreement, adjust the operating parameters and available functionality of the Service, and carry out actions to adapt it to specific Partner requests or technical features of the web resource.
Travelpayouts provide the respective Partner with the limited, revocable, non-exclusive, non-sublicensable license to install, copy and use the Service software solely as necessary for the Partner’s use of the Service on their web resource.
The Partner will have no right to copy, modify, adapt, translate, or otherwise create derivative works of the software product and related materials, including applicable Service documentation. It is prohibited to reverse engineer, decompiles, disassemble or otherwise attempt to discover the source code of the software tool, except as expressly permitted by the law in effect in the jurisdiction in which the Partner is located. The Partner will not rent, lease, sell, assign, or otherwise transfer rights in or to the Service software and related materials.
Travelpayouts reserves the right to modify, update, or discontinue the functioning of the Service software at their sole discretion, without any obligation to notify or obtain consent from any third parties including Partners using the Service.
Travelpayouts also disclaims any warranties or guarantees regarding the functionality or availability of the Service software, and will not be liable for any damages arising from its use for the particular purpose of the Partner or inability to use.
The permitted use of the Service lies within its functionality and intended purpose indicated in these terms. The Partner will not use, post, transmit, or introduce any device, software, or process which interferes or attempts to interfere with the operation of the Service for purposes other than its intended use under the Service functionality.
